This Disclaimer supplements our Terms of Service and Privacy Policy and governs certain statements and claims made by Vitality LLC, doing business as E+ROSE ("E+ROSE," "we," "us," or "our") on eandrose.com, in our cafes, in our marketing materials, and through our mobile application. Reading this disclaimer in full is important if you rely on any of our brand statements or nutritional claims when making decisions about your health, diet, or purchases.
2. Brand Tagline — "Eat Well, Be Kind. Defy Mortality."
Our brand tagline, "Eat Well, Be Kind. Defy Mortality.," and its component phrases — including "Defy Mortality" when used independently in our marketing, packaging, signage, or other brand communications — are aspirational expressions of the E+ROSE philosophy: that thoughtful food choices, kindness to others, and the active pursuit of vitality are worthwhile ways to live. We intend these phrases, individually and together, as creative brand voice and personal aspiration, not as medical claims, warranties, or guarantees of any specific health outcome.
Nothing in our tagline, our marketing, our packaging, our cafe signage, or our digital communications should be interpreted as a promise that our food prevents death, extends lifespan, cures or treats disease, or produces any specific medical result. "Defy Mortality" is a rhetorical invitation to live with intention — it is not a representation about the effect of any E+ROSE product on human longevity, mortality rates, or any medical condition.
Any health benefits you may experience from our food are individual and depend on factors outside our control, including your overall diet, medical history, genetics, lifestyle, and care from qualified healthcare providers. Always consult a qualified healthcare provider for medical guidance.
3. Nutritional and Health Information
Nutritional information, health-related statements, and dietary guidance provided on eandrose.com, in our cafes, on our packaging, and through our mobile application are offered for general educational and informational purposes only. This information is not:
- Medical advice, diagnosis, or treatment
- A substitute for consultation with a licensed physician, registered dietitian (outside of any one-on-one consultation you may separately arrange with our team), or other qualified healthcare professional
- Evaluated by the U.S. Food and Drug Administration
- Intended to diagnose, treat, cure, or prevent any disease
Always consult a qualified healthcare provider before making significant changes to your diet, especially if you are pregnant, nursing, managing a chronic health condition, taking prescription medication, or have a history of eating disorders. Individual results from any dietary approach vary and cannot be predicted or guaranteed.
4. Ingredient Claims and Scope of Menu Commitments
Scope of our ingredient commitments. When E+ROSE makes statements about what our food does or does not contain — including statements that we are "seed oil free," that our items contain "no cane sugar or corn syrup," "no gums," "no carrageenan," "no artificial preservatives," "no fake colors," or "no fake flavors" — those statements apply to the food and beverages that E+ROSE prepares in-house at our cafes, including our smoothies, smoothie bowls, toast, wraps, salads, coffee program, cold-pressed juices, and booster bites. These commitments do not extend to, and we make no representation regarding, third-party retail products sold on our shelves (which may include supplements, packaged snacks, and other curated items governed by their manufacturers' own ingredient choices). We review retail products before stocking them but do not control their formulations.
Honey in select items. While most of our smoothies and other menu items contain no added sweeteners, a limited number of items include raw local honey as an ingredient. Honey is clearly listed in the ingredient information for those items. Customers following a vegan diet, customers with honey allergies, and caregivers of infants under one year of age should consult the ingredient list and speak with a team member before ordering.
Ingredient changes. Recipes, suppliers, and preparation methods may change. While we make reasonable efforts to keep published ingredient information current, we cannot guarantee that every published list perfectly reflects every batch prepared. If absolute ingredient accuracy is critical to your health or dietary choice, please speak with a team member at your location before ordering, and request to review our current allergen documentation.
5. Allergens and Cross-Contact
Our commitment. E+ROSE takes food allergies seriously. Our team members are trained to handle allergy requests with care, to communicate clearly with customers about ingredients, and to take reasonable precautions to minimize cross-contact when a customer discloses an allergy or medical dietary restriction before ordering.
Allergens handled in our cafes. All E+ROSE cafes are shared kitchen environments in which multiple allergens are routinely prepared, processed, or handled using shared equipment, surfaces, utensils, and storage. Allergens handled on our premises include, but are not limited to:
- Tree nuts — including almonds, cashews, macadamia nuts, pecans, and walnuts (used across our smoothies, bowls, toast toppings, house-made nut milks, and booster bites)
- Peanuts (used in smoothies, bowls, toast spreads, and booster bites)
- Sesame (used in toast toppings and select spreads)
- Wheat and gluten (our sourdough toast is made with organic wheat flour; gluten is present in certain granolas, crackers, and other items clearly marked on our menu)
- Soy (present in some third-party retail products and minor ingredients; our in-house smoothies and bowls are formulated without soy, but cross-contact cannot be excluded)
- Eggs (present in select bakery items and certain retail products)
- Dairy (non-homogenized, pasture-raised whole milk is available as an option in our coffee program; cross-contact with dairy-handling equipment cannot be excluded)
- Coconut (classified as a tree nut by the U.S. FDA; used across smoothies, bowls, and toppings)
- Bee products — including raw local honey and bee pollen (used as a topping and in select items)
Upstream supplier facilities. Many of our ingredients — including nuts, seeds, oats, dried fruit, cocoa, spices, granolas, and other bulk dry goods — are sourced from third-party suppliers and processed at their facilities before reaching our cafes. Those supplier facilities may process other allergens beyond what we handle in-house, including fish, crustacean shellfish, mollusks, mustard, sulfites, or other allergens not directly used at E+ROSE. Supplier packaging typically carries "may contain" or "processed in a facility that also processes" statements to disclose this upstream cross-contact risk. Because we cannot observe or control supplier facilities, we cannot guarantee that any E+ROSE menu item is free from trace amounts of allergens introduced upstream, even when those allergens are not handled in our cafes.
What cross-contact means for you. Taken together, the shared-kitchen reality of our cafes and the shared-facility reality of our suppliers mean that trace amounts of any major allergen — including those listed above and fish, crustacean shellfish, mollusks, mustard, sulfites, and other allergens handled at supplier facilities — may be present on any item we prepare, even items that do not list that allergen as an ingredient. We do not operate a dedicated allergen-free facility, we are not a certified gluten-free facility, and we cannot guarantee that any item is entirely free from cross-contact with any allergen.
For customers with severe allergies, celiac disease, or medical dietary restrictions. If you have a severe allergy, anaphylactic risk, celiac disease, or a medical dietary restriction, we strongly encourage you to:
- Inform a team member of your allergy or restriction before placing your order, so our team can review current ingredient information and supplier labeling with you, and take additional preparation precautions where possible
- Understand that additional precautions reduce but do not eliminate cross-contact risk, particularly upstream cross-contact at supplier facilities that is outside our control
- Use your own judgment, in consultation with your healthcare provider, about whether eating at E+ROSE is appropriate for your level of risk tolerance
- Carry any emergency medication (such as epinephrine auto-injectors) prescribed by your healthcare provider
Customer responsibility. You are responsible for informing E+ROSE of any allergies or medical dietary restrictions prior to ordering, for reviewing ingredient and supplier information provided to you, and for exercising your own judgment about whether a given item is appropriate for your needs. By ordering from E+ROSE without disclosing an allergy or restriction, you acknowledge and accept the cross-contact realities of both shared-kitchen and shared-supplier environments.
Online and third-party orders. If you are ordering through our online ordering platform, mobile application, or a third-party delivery service, please note any allergy or dietary restriction in the order notes, and recognize that our ability to apply additional allergen precautions may be more limited for orders prepared without direct team member interaction. For severe allergies, we recommend ordering in person when possible.
6. Coffee Claims — Organic, Mold-Free, and Mycotoxin-Tested
E+ROSE describes our coffee program using terms such as "regenerative organic," "mold-free," and "tested for mycotoxins." These statements are based on the certified testing and sourcing practices of our coffee supplier, Purity Coffee, whose beans are independently tested for mycotoxins, mold, pesticides, and other contaminants. Certification and test documentation for Purity Coffee can be found on the Purity Coffee website. E+ROSE does not conduct independent laboratory testing on every batch of coffee we serve; our claims reflect our supplier's published standards and test results. Customers with mold sensitivities, mycotoxin illness, or related medical conditions should consult their healthcare provider and should not rely on our marketing statements as a substitute for medical guidance. 7. "#1 Rated" and Award-Related Claims
References to E+ROSE being "Nashville's #1 rated" for various categories, or winning "Best Juice Bar," "Best Smoothies," or "Best Smoothie Bowls," are based on specific reader polls, publications, or awards published at identified points in time (for example, Nashville Scene reader polls). These awards reflect the results of those specific polls or processes, not an ongoing independent certification, and do not imply a guarantee of quality or outcome for any individual customer. Past awards do not guarantee future performance.
8. Third-Party Retail Products Sold at E+ROSE
E+ROSE curates a limited selection of third-party retail products in our cafes, which may include supplements, packaged snacks, beverages, and other items. We select these products based on our own review of their ingredients and sourcing, but:
- E+ROSE does not manufacture these products and does not control their ingredient formulations, labeling, or marketing
- Claims made on the packaging or marketing of third-party products are made by their manufacturers, not by E+ROSE
- E+ROSE's brand-level ingredient commitments (for example, the "no cane sugar or corn syrup" commitment described above) do not extend to third-party retail products
- Any health, nutritional, or performance claims made by manufacturers of supplements or similar products have not been evaluated by the FDA and are not endorsed by E+ROSE
If you have questions about a specific retail product's ingredients, please consult the manufacturer's labeling and website, or contact the manufacturer directly.
9. Cleanses, Fasts, and Dietary Protocols
E+ROSE offers juice cleanses, intermittent fast-compatible products, and similar dietary protocols for customers who voluntarily choose to use them. These products are not intended as medical treatments, weight-loss prescriptions, or replacements for medical care. Customers considering any cleanse, fast, or significant dietary change should consult a qualified healthcare provider first, particularly if they:
- Are pregnant or nursing
- Are under 18
- Have diabetes, kidney disease, liver disease, an eating disorder history, or other chronic conditions
- Are taking prescription medications
E+ROSE is not responsible for adverse effects resulting from customer choices to undertake cleanses or fasts without appropriate medical guidance.
10. User-Submitted Content and Reviews
Testimonials, reviews, and customer-submitted content displayed on eandrose.com or our social media channels reflect the personal experiences of individual customers. Individual experiences are not typical, are not guaranteed, and are not medical evidence of product effectiveness. Customer content may be edited for length or clarity; we do not alter the substance of customer statements without consent.

Our website may contain links to external websites, including news articles, scientific publications, partner sites, and social media platforms. These links are provided for informational convenience. E+ROSE does not endorse, control, or take responsibility for the content, claims, or practices of any linked external sites.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Vitality LLC (doing business as E+ROSE) and its officers, directors, employees, agents, and affiliates are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your reliance on any information provided on eandrose.com, in our cafes, or in our marketing. Your use of E+ROSE products and reliance on E+ROSE information is at your own risk. This limitation is subject to and complements the more detailed limitation of liability set forth in our Terms of Service.
